X23 <br /> to <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6677 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Cottage Grove. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Cottage Grove be amended to include in the R-1A Residential <br /> District/s the following described land: <br /> PETITION NUMBER: 6677 <br /> Part of the NE 1/4 SE 1/4 of Section 33, Town of Cottage Grove described as follows: <br /> Commencing at the East quarter corner of said Section 33; thence S 01° 05' 14"East, <br /> 32.75 feet; thence S 88° 26' 27"East, along the South line of USH 12-18, 445.06 feet to <br /> the point of beginning; thence S 00° 20' 49"West, along an existing cemetary, 214.65 <br /> feet; thence S 81° 16' 45"West, 293.91 feet; thence N 11° 31' 44"East, 257.88 feet to <br /> the South line of USH 12-18, thence N 88° 26 `46"East,150.00 feet; thence N 88° 26' <br /> 27"East, along the South line of USH 12-18, 107.01 feet to the point of beginning. <br /> CONDPITONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following iest'ictions on said land: <br /> 1.There shall be no Certified Survey Map created for the existing R-3A property. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site.
