MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF DECEMBER 28, 1978 <br /> PRESENT: Dahlk, Krushchke, Purcell, Schwahn, Voges <br /> ALSO PRESENT: Enger. <br /> I <br /> Meeting was called to order at 7:25 p.m. by Chairman, Pro-tem,Dahlk <br /> in Room #224 City-County Building to hold a public hearing as advertised <br /> by Class II Notice. Motion by Voges second by Schwahn to approve the <br /> minutes of November 30 and December 27, 1978. Motion carried. <br /> #742. Appeal by Gary and Mary Gummer for a variance from required side <br /> yard as provided by Section 10.06 (7) - Dane County Zoning Ordinance. <br /> Variance is necessary to permit a garage addition to a residence on Lot <br /> #101, 3rd Addition Tower Hill, Section 9, Fitchburg. <br /> IN FAVOR: Gary Gummer OPPOSED: None TOWN BOARD: Not present. <br /> #743. Appeal by Michigan Wisconsin Pipeline Company for a variance <br /> from required setback from CTH "A" as provided by Section 10.17 (2) - <br /> Dane County Zoning Ordinance. Variance is necessary to permit con- <br /> struction of a building in part of the NE 1/4 SW 1/4 Section 9, Town <br /> of Dunkirk. <br /> IN FAVOR: Marvin Maxim OPPOSED: None TOWN BOARD: Letter in approv. 1 <br /> DANE COUNTY HIGHWAY: Letter, no objection with condition. <br /> #744. Appeal by Donald Benedict for a variance from required lot width <br /> (1110 and area as provided by Section 10.16 (7) (b) - Dane County Zoning <br /> Ordinance. Variances are necessary to permit division of Lots 13, 14, <br /> and 15, and 16, Block 3, Edgerton Beach Park, Town of Albion. <br /> IN FAVOR: Jeff Roethe OPPOSED: None TOWN BOARD: Not present. <br /> Public hearing was closed. <br /> #742. Motion by Voges second by Schwahn to hold in abeyance until <br /> January meeting to provide time to check out property deed restrictions <br /> and possible alternate plans for location of garage. Motion carried. <br /> #743. Motion by Schwahn second by Purcell to grant a variance of 20 fee <br /> from required setback from centerline of CTH "A" which is in accordance <br /> with request of Dane County Highway Department. <br /> FINDING OF FACT: <br /> 1. Location of proposed building predetermined by existing equipment <br /> and required truck service access. <br /> 2. New monitering procedure required by the State necessitates con- <br /> struction of building for equipment. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest, <br /> c. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br />
