BOA MINUTES 12/17/98 <br /> PAGE 1 <br /> BOARD OF ADJUS TME t 3 T MINUTES <br /> December 17, 1998 <br /> PRESENT: Klopp, Kay, Ross, Long and Bitzer <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. by Chair Kay in Room 2- <br /> F City-County Building to hold Public Hearing as published <br /> by Class II Notice. <br /> Minutes: KLOPP/LONG to amend minutes of 11/19/98 RE: Appeal <br /> #2981, motion to read: <br /> KAY/ROSS to find that the work completed and proposed, from <br /> which the major systems, heating, plumbing, electrical and <br /> structural systems are included, not withstanding Section <br /> 17. 05 (50) (a) , constitute modifications to be included in <br /> computation of the 50% rules. (Long, no) . Motion carried - <br /> 3-1 . <br /> KLOPP/LONG to approve minutes of November 12, 1998 and <br /> minutes of November 19, 1998, as amended. Motion carried - <br /> 5-0. <br /> #3000. Appeal by Jim & Linda Van DenBerg for a variance from <br /> required sideyard as provided by Section 10.05 (7) to permit <br /> garage addition to existing residence at 6234 Goede Circle being <br /> Lot #2, Larwood Hills, Section 31, Town of Westport. <br /> IN FAVOR: L. Van DenBerg OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> LONG/ROSS to deny variance of 2. 6 feet from required right <br /> sideyard to permit addition to existing residence as proposed. <br /> Finding of fact: <br /> 1) . Applicant proposes to add a 12' x 40' garage addition to <br /> existing residence. <br /> 2) . Applicant wishes to utilize existing concreted area for <br /> garage expansion and workshop. <br /> 3) . Applicant has corner lot with septic system located in <br /> front yard. <br /> 4) . Storage needed for 2 cars, boat, mowers, bicycles and <br /> utility trailer. <br /> 5) . Appears design alternatives or detached garage could meet <br /> storage needs. <br /> Conclusion: <br /> 1) . Unnecessary hardship was not proven. Motion carried - 5-0. <br /> #3001. Appeal by Michael Skindrud & Marilyn Essex for a <br /> variance from required sideyard as provided by Section 10.07 (7) <br /> to permit structural alteration of existing residence at 2166 <br /> k <br />
