'DECLARATION OF PROTECTIVE COVENANTS

<br />WHEREAS, the undersigned are the owners of all of the lots in
<br />the Sunrise Addition to the Village of Sun Prairie, Dane County, Wis-
<br />consin, which addition is comprised of Outlots 156 and a part of Out-
<br />lot 158 of the Assessor's Plat; Outlots 1, 2, 3 and 4 of the Dunphy
<br />Addition and Lots 12 and 13 of Kleiner's Addition, all in the Village
<br />of Sun Prairie, Dane County, Wisconsin, the plat of said Sunrise
<br />Addition being on record in Volume 15 of Plats on page 15, Dane County,
<br />Wisconsin, Registry.
<br />WHEREAS, it is deemed proper to impose upon the lots in said Sun-
<br />rise Addition certain restrictions, reservations, limitations and
<br />covenants which are hereinafter set forth, for the benefit and Protec-
<br />tion of the owners, present and future, of the lots in said subdivision;
<br />NOW, THEREFORE, IT IS HEREBY DECLARED AND AGREED that the follo.v-
<br />in; restrictions, reservations, limitations and covenants be and the
<br />same hereby are adopted, and that the lots in said Sunrise Addition
<br />be subject thereto, as follows, to-wit:
<br />ARTICLE I
<br />These covenants are to run with the land and shall be bindinyy, on
<br />all parties and all persons claiming under thea, until January 1, 1973,
<br />at which time said covenants shall be automatically extended for
<br />successive periods of ten (10) years, unless by vote of a majority of
<br />the then lot owners it is agreed to modify said covenants in wr.ele or
<br />in part.
<br />If the parties :.ereto, or any of therr,, or their .heirs, succes6or6,
<br />or assigns shall violate or attempt to violate any of the ccvena is
<br />oi, restrictions herein, it s.-all be lawful for any other 1.,erson or
<br />xersons owning any real Nroperty situated in said addition to prose-
<br />cute any proceedings at law or in equity a- inst the peruon or persons
<br />violatin , or attemptin; to violate, any such covenants or restrictions,
<br />and eitL.er to prevent him or thea from so doing or to recov:;r dawa_es
<br />or other forfeitures for such violation.
<br />Invs.lidation of any of these covenants by judgment or court order
<br />shall in no wise affect any of the other provisions, whicr shall rz-
<br />main in full force and effect.
<br />AFTICLF II
<br />All lots in said Sunrise Addition, exce;t T,ot ::, Fled- 3, shall
<br />be known and described as residential lots. No structure sl.all be
<br />erected, altered, placed, or perp-itted to remain on any lot other

<br />Ernest Freide� all'of Sun Prairie, Wisconsin.
<br />In the event of the death or resignation of any member of said
<br />comn.ittec, Gerald Yelk, or his personal representative in the event
<br />of his death, s1niall have full and sole authority to name a successor
<br />committee member. In the event said committee fails to ar:�.rove or
<br />disapprove any design and location within thirty (30) days after
<br />said plans and specifications have been submitted to it, such ap-
<br />proval will not be required, and this covenant will be deemeu to
