If he wants to change the use other something
other than new and used car sales, he will have to amend the deed restriction. To amend
the deed restriction is the same process of rezoning. The Town and County will need to
decide whether or not to allow additional land uses.

I have not suggested opening the parcel up to all C-2 land uses. I stated that he will
need to revised the deed restriction to what the intended buyer wants to do with the
property. He will need to submit a rezone petition and go through the process just like
everyone else. If he can in by today, he would be placed on the Feb 23 ZLR public hearing.

The property is very small with no parking available. The property should be very
restricted to any commercial activity.

Roger

-----Original Message-----
From: Kim Banigan [mailto:clerkcgtown@verizon.net]
Sent: Wednesday, December 30, 2009 12:47 PM
To: Lane, Roger
Subject: Goff property

Hi,

I understand that you had a conversation with Dan Goff regarding his
commercial property on County BB that he is trying to sell. He told me you
recommended amending his C-2 zoning to remove all conditions, and that he
needed the Town's approval before January 17th.

Unfortunately, our Plan Commission does not meet until Jan 27th. I spoke
with Town Chair Kris Hampton, and he feels that we do need to have the
amendment considered by the Plan Commission in addition to the Town Board,
as well as give adequate notice to the neighbors.

It seems to us that allowing permitted use (w) All uses permitted in the
LC-1 district would cover the use intended by Mr. Goff's potential buyer,
and we are wondering why you would suggest opening it up to all C-2 uses?

Kim Banigan
Clerk, Town of Cottage Grove
4058 County Road N
Cottage Grove, WI 53527
Phone: (608) 839-5021
Fax: (608) 839-4432
www.tn.cottagegrove.wi.gov

1
