This <br />request is for an area <br />coveri ng 19 acres for a <br />period of 10 years. Existing <br />CUP # 1638 is set to expire <br />on June 27, 2010. Yahara <br />Materials is the operator of <br />the site. <br /> <br />Observations: An erosion <br />control (Chapter 14) and <br />nonmetallic mining <br />reclamation permit (Chapter <br />74) are required. <br />Reclamation permit number <br />74-95 is associated with this <br />operation. <br /> <br />Town Plan: Property is <br />located in the town's "Rural <br />Preservation Area". <br /> <br />Staff: Please see attached <br />staff report for additional <br />information and list of <br />recommended conditions. <br /> <br />Town: Approved. <br /> <br /> <br />5/11 8r.. 6/8 ZLR: Postponed due to committee concerns regarding site safety and public <br />opposition. Conditions were to be revised to include a 20-foot setback, benching, and <br />fencing. The committee also instructed staff to work with Mr. & Mrs. Loewi to address <br />concerns. <br /> <br />Staff: Staff met with the Loewi's, Yahara Materials, and Town Chair regarding appropriate <br />conditions for the site. Outstanding issues that need to be decided: <br /> <br />Time Limit lanauage: Termination vs. Cease. Argument: The Loewi's would like the site <br />reclaimed in 10 years, Yahara would like the option to continue excavation past 10 years. <br /> <br />Excavation limits: 20-foot setback with 10-foot bench vs. 10-foot setback with 10-foot <br />bench. Argument: Yahara materials stated a 20-foot setback at a previous meeting. But <br />after review they would like to have the 10-foot benching included in the 20-foot setback <br />due to the high quality of material on the site. <br /> <br />Request for north buffer area: 40-foot buffer area along north property line. Argument: <br />The Loewi's would like to have a buffer that consists of the existing trees. Yahara had <br />planned to remove material from this area. <br /> <br />Fencing: Fencing from gate to gate vs. 300-foot reduction along south border.
