An inspection was conducted on May 24, 2010 resulting in <br />CUP #1638 being not in compliance. The following observations were made on site: <br /> <br />Condition #5 - Total disturbed area of the site shall not exceed 10 acres. <br />Verified approximately 7.5 acres including the haul road. <br /> <br />Condition # 1 0 - The access to the driveway shall have gates securely locked when the extraction <br />site is not in operation. The site shall be signed "NO TRESPASSING." <br />One half of the gate was not properly in place and no" NO TRESPASSING" signs installed. <br /> <br />Condition # 14 - There shall be a safety fence around the entire extraction area at all times, as per <br />the agreement between Y ahara Materials Inc. and surrounding property owners. This fence shall <br />be comprised of a basic barbedwire farm fence with posts and "NO TRESPASSING" signs at <br />regular intervals around the entire perimeter of the anticipated disturbed area. <br />There is only a safety fence on the easterly limits of the quarry. <br />No "NO TRESPASSING" signs installed. <br /> <br />Also, it should be noted that there is no topsoil on site with respect to future reclamation. <br />Topsoil will have to be brought on site to achieve the requirements of the reclamation permit. <br /> <br />This letter serves as notice that Yahara Materials and the owner have 30 days to bring the site in <br />to compliance with respect to conditions #10 and #14. Compliance will be expected by no later <br />than June 28, 2010. Failure to do so may result in citations being issued and if the operation is <br />not in reasonable compliance with the terms of Conditional Use Permit #1638, such approval is <br />subject to amendment or revocation. <br /> <br />210 Martin Luther King]r.
