\\ Cv-0 0 J

Dane County CUP Application #2135
Yahara Materials "Norslien Quarry," 4138 Hwy 78, Black Earth, WI 53515

Background
· Approved for Hwy 78 project in 1990, Due for review in 1995 (not completed?)
. Extended for another 10 years in 2000
· No notice to adjacent or nearby landowners by town of Vermont when CUP was
approved by them in March, 2010
· Landowners wonder why this 19 acre quarry needs another 10 years: we've been
patient and lived with blasts and unsafe conditions for 20 years already

Current Requirements:
· Access to the driveway is to have gates securely locked when the extraction site is
not in operation, and be signed "No Trespassing."
· Operations were to cease 10 years from the date of CUP approval. Now it's been 20
years. That should be enough for a small quarry.
. Driveway to be paved.
· Total "disturbed area" shall not exceed 10 acres. Now asking to increase to the
whole 19 acres.
· Safety fence around the entire extraction area at all times, with "no trespassing"
signs at regular intervals around the entire perimeter of the anticipated disturbed
area. In fact Yahara has constructed fencing around just a portion of the eastern
edge of the quarry, with no signs.
· Have encroached on our property by approx. 10 feet. Were required to stay 20 feet
from the property line. Violation of approx. 30 feet.
· Reclamation should not be put off another 10 years. There's little left to quarry.
· Incorrect address on Yahara application and County notices: we wonder if this
caused confusion by neighbors thinking it was for another quarry miles away and
possibly incorrect notification.

Adjoining Property uses:
· Farming (tillable land has been leased to Don Ripp for more than 22 years)
· Tree farm - Christmas trees for Cut your Own operation are in two adjacent fields
. Hunting (CWD Zone)
. Cross Country Skiing/Mountain Biking
. Hiking/Dog Walking! Horseback Riding
. Entertaining
. Birding/wildlife viewing
