The ZLR Committee has requested that Yahara Materials
furnish additional information regarding the mineral extraction operation located on
parcel #0706-021-9070-7 in the Town of Vermont.

This information is necessary to allow the committee to decide whether or not the
operation meets the six standards for granting a conditional use permit. More
specifically, the information will need to show; 1) that the establishment,
maintenance and operation of the conditional use will not be detrimental to or
endanger the public health, safety, or general welfare, and 2) that the uses, values,
and enjoyment of other property in the neighborhood for purposes already
permitted shall be in no foreseeable manner substantially impaired or diminished
by the establishment, maintenance, or operation of the conditional use.

The ZLR Committee would like a layout plan of the site that shows where the
existing excavation is currently being conducted and where future excavation will
be conducted. The plan shall also show the location of the land to be reclaimed in
order to limit the disturbed area to 10 acres. The plan will need to be prepared and
stamped by a licensed surveyor to ensure accuracy.

The ZLR Committee would also like additional features or conditions to be added
to the site in order to meet the two standards of granting a conditional use permit
as mentioned above. These features are as follows:

1. The extraction area shall be located no closer than 20 feet to the adjacent
property line.
2. The installation of a 5-foot tall woven wire fence along the property lines.
3. The vertical portions of the excavation site to be benched to prevent a shear
drop-off.
