X46" <br />r/ i 1 <br />44 <br />Division of Zoning <br />June 27, 2012 <br />Mr. Scott Freitag <br />2898 Burke Road <br />Sun Prairie WI 53590 <br />RE: Appeal 3633 by Scott Freitag for a variance from the maximum 10% lot coverage as provided by <br />Section 10.04(1)(b)4., Dane County Code of Ordinances, for property located at 2898 Burke Road, <br />Section 20, Town of Sun Prairie. <br />Dear Mr. Freitag: <br />On April 26, 2012, the Dane County Board of Adjustment APPROVED your Variance Appeal 3633. A <br />copy of the minutes of the meeting are as follows: <br />Motion: Studz/Long to grant variance 0.4% from the maximum allowed 10% lot coverage to permit an addition to the connect <br />two existing accessory buildings. <br />Finding of Fact: <br />• The lot was created on October 11, 1999. <br />• The total lot coverage was 10.8%. <br />• The lot coverage was conforming with no lot coverage requirement under A-2(4) District. <br />• The 48 -foot by 15 -foot addition will connect two buildings. <br />• The total lot coverage will be 15% - 10% required; 15% proposed; 5% relief granted. <br />• The ordinance was changed and the 10% lot coverage was effective August 2, 2011. <br />COMMUNICATIONS: Minutes of the Town of Sun Prairie, Town Board support of the variance. <br />Conclusions: <br />1. Unnecessary Hardship: The ordinance change created a non -conforming lot. <br />2. Unique Limitations of the Property: The landowner is unable to purchase additional lands to provide compliance. <br />3. No Harm to Public Interests: The addition is not located within the setback. <br />Motion carried: 4 — 0. <br />As a result of your successful variance appeal, you may obtain the Dane County zoning permit required <br />for the 48' x 15' addition to connect the two accessory buildings. <br />Please submit a personal check, payable to Dane County Zoning, for $104.00, the permit fee.
