William Remis <br />AGENT: -- <br />LOCATION: 853 Ridgewood Way, Lot 15, Block 5, Oak Ridge Subdivision, Town of Madison, Section 35 <br />ZONING DISTRICT: B-1, Business District <br />COMMUNICATIONS: Town of Madison <br />Facts of the Case: <br />• The Oak Ridge Subdivision was recorded on October 30, 1908. <br />• The B-1, Business District, Zoning Ordinance Amendment No. 1073, was effective on August 27, <br />1965. <br />Existing: <br />• The existing garage is 6.4 feet from the right-of-way line for Cypress Way. <br />• A lean-to, shown on the surveyor's Plat of Survey, April 30, 2012, encroaches 1.2 feet into the right- <br />of-way for Cypress Way. <br />Proposed: <br />• The owner proposes a garage addition and a new conditioned space to the house at 6.0 feet from the <br />right-of-way line for Cypress Way. <br />Zoning Notes: <br />• The exception for setback requirements on corner lots in Section 10.16(4)(b)2. is 20 feet, the same as <br />Section 10.17(4)(b), Class D Highway. <br />• The residence is a non -conforming use in the business district, Zoning Ordinance Amendment No. <br />1781, September 24, 1976. <br />History: <br />• No zoning permit records were found for this lot. <br />Violation History: -- <br />VARIANCES REQUESTED: <br />Minimum required setback from right-of-way: 20 feet. <br />Actual setback from right-of-way line: 6.4 feet. <br />Proposed setback from right-of-way: 6.0 feet. <br />VARIANCE NEEDED: 14 feet. <br />
