submits the political process is their only recourse here as
well.
CONCLUSION
The interpretation given the Dane County Zoning Ordinance
by the Board of Adjustment should stand. There is no conflict
with prior interpretations, the special treatment afforded
mineral extraction operations has a rational basis and the
state statutes on the County's zoning powers expressly
authorizes special treatment of such uses as the County may
designate.
Sec. 59.97(10), stats., does not prohibit Dane County
from affording a special status to mineral extraction
operations. Relators -Plaintiffs read this section in
isolation and then treat the label given this use as
determinative of the issue. This argument should be given the
short shrift it deserves, and the Dane County Zoning Ordinance
upheld.
Dated this 9th day of August, 1983.
Room 313D
City -County Building
Madison, WI 53709
608-266-4356
Respectfully submitted:
QA -w
4,Aj11***--
Cal W.
