The Dane County Board of Supervisors does ordai• :''ollows: That 7 Zoning District Maps of the Town of Albion be amended to in di in the R-1 Residenti:1 District/s the following described land: PETITION NUMBER: 8383 Part of the S 112 SE 114 Section 5, Town of Albion described as follows: Lot #3, CSM #9667 found in Volume 55, Page 284 of Certified Survey Maps,Dane County Register of Deeds. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. RECORDING OF AN APPROVED PLAT REQUIRED The above listed description/s is/are intended to describe land for which a plat will be prepared for approval and recorded. This amendment will become effective,if within one year of its approval by Dane County,a plat that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the plat will cause this amendment to be null and void. A copy of the recorded plat shall be submitted to Dane County Zoning. The rezoned area shall be subject to the following conditions. 1. Within one year from the date of approval,the landowner shall: a.record a subdivision plat with the register of deeds that complies with all requirements of Chapter 75 of the Dane County Code; b. submit a stormwater control plan approved by the Dane County Land Conservation Department that conforms to all requirements of Chapter 14 of the Dane County Code, including those provisions that take effect on August 22,2002; c. record deed restriction documents,in a form approved by the zoning administrator, that identify at least 185 acres of land in the RE-1 or CO-1 zoning districts that are to be legally joined for the purposes of meeting the open space requirements of the Dane County Farmland Preservation Plan for the Town of Albion. Such restrictions should meet all applicable requirements of Section 10.16(3)(b)of the Dane County Code. 2.
