DANE COUNTY ORDINANCE AMENDMENT NO. 8976 <br /> ending Section 10.03 relating to Zoning Districts in the Town of Madison. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of <br /> Madison be amended to include in the C-2 Commercial District/s the following described land: <br /> PETITION NUMBER: 8976 <br /> A parcel of land located in the SW 1/4 of the NW 1/4 of Section 36, Town of Madison and also part of Lots 2 an 3, <br /> Block #2, Jacobs and E. S. Barker's Subdivision more particularly described as follows: Beginning at the most <br /> Southwesterly corner of said Lot #3, Block #2, Jacobs and E.S. Barker's Subdivision; thence N00°31'18" East, <br /> 197.22 feet; thence along the arc of a curve concaved Northerly having a radius of 11569.35 feet and a long chord <br /> bearing N68°06'20" East, 206 60 feet; thence N70°38'01" East, 144.18 feet; thence N82°40'29" East, 140.65 feet; <br /> thence S82°42'37" East, 126.88 feet; thence S00°04'03" West, 354.62 feet; thence N89°06'14"West, 436.05 feet; <br /> thence N00°31'58" East, 131.99 feet; thence N89°05'38" West, 59.79 feet; thence S00°31'58" West, 10.00 feet; <br /> thence N89°06'14"West, 66.00 feet; thence S00°31'58"West, 122.00 feet; thence N89°06'14"West, 33.00 feet to <br /> the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2(b) of the Dane County Code of <br /> 1 nances. The rezoned area shall be subject to the following condition(s). <br /> DEED RESTRICTION REQUIRED <br /> nis amendment will be effective if within 90 days of its adoption by Dane County the owner or owners of the <br /> land record the following restriction(s) on said land: <br /> 1) Deed restrict the property exclusively to the following uses: <br /> a. All uses permitted in the C-1 Commercial District, DCCO without limitations as to size; <br /> b. Major repaire to motor vehicles; <br /> c. Sales of new and used motor vehicles; <br /> d. Sales of new and used contractor's machinery and equipment; <br /> e. Repaors, storage and service of contractor's machinery and equipment; <br /> f. Sales and storage of lumber and building material; <br /> g. Utility services; <br /> h. Parking or storing of motor vehicles; <br /> i. Warehouses. <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restriction(s) will cause the rezone to be null and void. <br /> • <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> woof <br /> Effect'rve --- C- . <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the <br /> provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
