EFFECTIVE: APRIL 6, 2015 <br /> Dane County Board of Supervisors <br /> Amending Chapter 10 of the Dane County Code of Ordinances <br /> Zoning Map Amendment Petition 10780 <br /> Dane County Board of Supervisors does ordain as follows: <br /> The Zoning Districts Maps as referenced under Dane County Code of Ordinance Section 10.03 <br /> shall be amended as follows: <br /> Town Map: Town of Perry Location: Section 34 <br /> Zoning District Boundary Changes <br /> Lot 1: A-1 EX to RH-3 <br /> That part of the Northwest 1/4 of the Southeast 1/4 of Section 34, Town 5 North, Range 6 East, Perry Township, Dane <br /> County Wisconsin, more fully described as: Commencing at the Northwest corner of the said Southwest'/; <br /> thence N 89°24'25"E, 2716.56' to a 272" pipe at the Northwest corner of the said Southeast% and the point of <br /> beginning; ; thence S 1°55'18"W along the West line thereof, 781.19'; thence S 14°18'10"E, 566.51' to the South <br /> line of the Northwest% of the said Southeast 1/4; thence N 89°43'56"E along said South line 576.05' to the <br /> Southwest corner of CSM 2364 of Dane County; thence N 32°24'26"W, 794.12' to the Northwest corner thereof; <br /> thence N 89°43'54"E along the North line thereof, 302.07' to the center line of York Valley Road; thence <br /> Northerly, 531.45' along the said center line, being the arc of a 3°24' curve to the left having a radius of 1685.17' <br /> and a central angle of 18°04'10" and making a long chord of 529.25' that bears N 24°17'26"W to a point of <br /> compound curvature; thence continuing on said center line, 226.17' Northwesterly being the arc of a 1003.77' <br /> radius curve to the left with a central angle of 12°54'36" and making a long chord of 225.69' that bears N <br /> 39°46'59"W to the North line of the aforesaid Southeast 1/4; thence S 89°49'05"W, 204.13' to the point of <br /> beginning. Parcel contains 13.42 acres (584,512 square feet), more or less, and is subject to any and all easements <br /> and rights-of-way of record and/or usage, including but not limited to the easterly 33' for York Valley Road. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane County <br /> Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the owner or <br /> owners of the land record the following restriction(s) on said land: <br /> 1. A deed restriction shall be recorded on the proposed lot to prohibit sub-division of the <br /> parcel. <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as <br /> the owners of land within 300 feet of the site. Failure to record the restriction(s) will cause the <br /> rezone to be null and void. A copy of the recorded document shall be submitted to Dane County <br /> Zoning. <br />
