DANE COUNTY ORDINANCE AMENDMENT NO. 9243 EFFECT: 9-28-08 <br /> nding Section 10.03 relating to Zoning Districts in the Town of Dane. <br /> ...�;Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of <br /> Dane be amended to include in the RH-4 Rural Homes District's the following described land: <br /> PETITION NUMBER: 9243 (Revised 2/1/08) <br /> A parcel of land located in the NE 1/4 and SE '/4 of the SE 1/4 of Section 12, T9N, R8E, Town of Dane, Dane <br /> County, Wisconsin more particularly described as follows: Beginning at the Southeast corner of said Section <br /> 12;thence S 89° 54' 48" W, 1278.79 feet; thence along the arc of a curve concaved northwesterly having a <br /> radius of 1720.89 feet and a long chord bearing N 36° 32' 36" E, a distance of 192.10 feet; thence N 33° 36'50" <br /> E, 591.32 feet; thence along the arc of a curve concaved southeasterly having a radius of 1909.86 feet and a <br /> long chord bearing N 43° 13' 26"E, a distance of 636.74 feet; thence N 52° 49' 11" E, 363.91 feet; thence <br /> along the arc of a curve concaved northwesterly having a radius of 1762.95 feet and a long chord bearing N 50° <br /> 52' 52" E, a distance of 119.27 feet to a point on the east line of said SE 1/4 of said Section 12; thence S 0° 45' <br /> 19"E along said east line 1404.11 feet to the point of beginning. This parcel is subject to a road right of way of <br /> 33.00 feet over the most southerly, westerly and northerly portion thereof. This parcel contains 23.56 acres <br /> including road right of way and is subject to a 250 foot wide flight runway maintenance easement over a portion <br /> of the above described parcel, said easement is more particular described as follows: Commencing at the <br /> Southeast corner of said Section 12; thence N 0° 45'19" W, along the east line of said SE 1/4 of said Section 12, <br /> 696.35 feet to the point of beginning. Thence N 64° 45' 44"W, 587.53 feet to a point on the easterly right of <br /> way of County Highway"DM"; thence along said easterly right of way on the arc of a curve concaved <br /> southeasterly having a radius of 1876.86 feet and a long chord bearing N 49° 37' 13"E, a distance of 209.50 <br /> `; thence continuing along said easterly right of way N 52° 49' 11"E, 66.78 feet; thence S 64° 45' 44"E, <br /> ,.23 feet to a point on the east line of said SE '/4 of said Section 12; thence S 0° 45' 19" E along said east line <br /> 278.13 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if, within 90 days of its adoption by Dane County, the owner or owners of the <br /> land record the following restriction(s)on said land: <br /> 1. Deed restrict 15 acres of land on the West side of County Trunk Highway DV to prohibit residential <br /> development in the boundary. The boundary is described as follows: <br /> A parcel of land located in the SW '/4 and the SE '/4 of the SE '/4 of Section 12, T9N, R8E, Town of Dane, <br /> Dane County, Wisconsin more particularly described as follows: Beginning at the South '/4 corner of said <br /> Section 12; thence N00°28'40"W along the north/south line of said Section 12, 424.08 feet; thence <br /> N89°54'48"E, 1685.04 feet to the centerline of CTH"DM"; thence S33°36'50"W along said centerline, <br /> 324.43 feet; thence along the arc of a curve concaved southeasterly having a radius of 1720.89 feet and a <br /> long chord bearing S36°32'36"W, a distance of 192.10 feet to the south line of the SE '/4 of Section 12; <br /> thence S89°54'48"W along said south line, 1387.52 feet to the point of beginning. This parcel contains <br /> 15.00 acres including road right of way and is subject to a road right of way of 33.00 feet over the most <br /> easterly portion thereof. This description is to be used for restricting development on the parcel described <br /> above and for no other purpose. <br /> J restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as the owners of land <br /> within 300 feet of the site. Failure to record the restriction(s) will cause the rezone to be null and void. A copy of <br /> the recorded document shall be submitted to Dane County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment, based upon their findings,to be consistent with the <br /> provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
