King Jr. Blvd. <br /> Madison, WI 53703 <br /> DANE COUNT GLERK <br /> Mr. Miles, <br /> The Town of Vermont is in receipt of a request to approve rezone petition No. 10705 upon <br /> which a condition has been imposed by Dane County: <br /> 'The southerly property line shall be shifted to the south in order to obtain 15% impervious <br /> surface within the Shoreland District affecting the property' <br /> The authority for this change is given as Section 10.255(3)(a)2.(b) of Dane County Code of <br /> Ordinances. <br /> The Vermont Town Board is returning this as neither approved nor disapproved based on a lack <br /> of sufficient information. <br /> (1) This rezone was approved by the Town based on the original boundaries after a site <br /> visit by the Planning Commission. It would be inappropriate to approve a modified <br /> rezone based upon a vague "shall be shifted to the south" specification. <br /> (2) The section of the Dane County ordinances quoted provides for an adjustment of <br /> rezone petitions but nowhere was referenced the justification or authority for moving <br /> a property line based on the 15% impervious surface. More generally, there was no <br /> justification or authority referenced for adjusting property lines based on Shoreland <br /> Zoning. <br /> (3) Nowhere was it indicated that the change was made with the involvement and willing <br /> concurrence of the property owner, Mr. Grover. <br /> The Vermont Town Board's position will remain as neither approved nor disapproved until such <br /> time as more information is provided. <br /> Marc Robertson <br /> Clerk <br /> Town of Vermont <br /> CC Roger Lane, Eric Grover and Scott McDonell <br />
