TOWN OF BURKE RESOLUTION NO. 01212015A RESOLUTION BY THE TOWN BOARD OF THE TOWN OF BURKE CONDITIONALLY APPROVING THE REZONE FROM C-2 TO R-2 AND CONDITIONAL USE PERMIT SUBMITTED BY CINDY WHITEAKER ON BEHALF OF SHELTER FROM THE STORM MINISTRIES WHEREAS, an application for a rezone from C-2 to R-4 with a Conditional Use Permit (CUP) to allow for community living for more than 16 people for the purpose of operating a homeless shelter at the property located at 3392 Brooks Drive, Sun Prairie, parcel number 0810- 123-8850-0 was submitted by Cindy Whiteaker of Shelter From The Storm Ministries; WHEREAS, the Plan Commission has reviewed the Rezone and CUP application and recommended conditional approval of the rezone and CUP; and WHEREAS, after receiving input from the City of Sun Prairie the applicant revised the application requesting a rezone from C-2 to R-2 (not R-4); and WHEREAS, per County Zoning regulations under R-2 zoning a Conditional Use Permit is need for community living for 9 or more people;and WHEREAS, the Town Board has reviewed the revised application and considered the Plan Commission's recommendation. NOW, THEREFORE, the Town Board hereby approves the rezone and CUP subject to the following conditions: 1) the Conditional Use Permit is only valid if the property is being used as a facility to serve homeless women and children as stated in the letter of intent and the property is rezoned to R-2; and 2) all requirements, certifications and permits required by City of Sun Prairie, Dane County and State of Wisconsin are met; and 3) all remodeling codes are met; and 4) the property is either connected to City of Sun Prairie sewer or the steps are taken to assure that the septic system is designed to meet the needs of the building occupancy.
