• <br /> TOWN OF BERRY <br /> DANE COUNTY <br /> WISCONSIN <br /> September 20, 1996 <br /> George Acker <br /> 6328 Aspen Lane <br /> Mazomanie, WI 53560 <br /> Dear George, <br /> The current Town of Berry Land Use Plan adopted April 13, 1981 and revised March 1, <br /> 1988 states, "The owner of a parcel, or contiguous parcels totaling more than thirty-five <br /> acres may create that number of lots determined in the following manner. The total <br /> number of contiguous acres will be divided by thirty-five. If the resulting quotient is a <br /> whole number, the owner may create that number of lots. If the quotient is a whole <br /> number plus a fraction, the owner may create that number of lots equal to the whole <br /> number plus one additional lot if the remaining fraction equal or exceeds 18/35." <br /> Further, "In order to prevent the occurrence of multiple divisions by successive land <br /> owners, this limitation shall run with the land; shall be accumulative; and shall apply to <br /> those persons or entities owning land within the town on adoption of this plan, and to their <br /> grantees, heirs, successors and assigns. The limitation established by this policy will be <br /> applied until further study indicates a need to amend the plan." <br /> At our regular Board meeting on September 16th, we determined through discussion and <br /> subsequent motion that your 62.6 acres divided by 35 would allow you to create two <br /> additional lots. Minimum lot size is a net two acres. However, I would suggest that you <br /> discuss your plans with Dane County Zoning because of their rules that dictate all lots less <br /> than 15 acres must have a 66 foot public road access frontage.
