DANE COUNTY ORDINANCE AMENDMENT NO.8077 Amending Section 10.03 relating to Zoning Districts in the Town of Springfield. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Springfield be amended to include in the A-2(4)Agricultural and C-2 Commercial District/s the following described land: PETITION NUMBER: 8077 TO A-2(4): Located in the SW 114 of the SW 114 of Section 4, Town of Springfield described as follows: Commencing at the Southwest corner of said Section 4; thence S89°25'54"East 348.50 feet to the point of beginning. Thence N01°29'17' East 737.58 feet; thence S88°59'58" East 60.00 feet; thence S01°52'37" West 737.22 feet; thence N89°25'54" West, 55.00 feet; to the point of beginning. TO C-2: Located in the SW 114 of the SW 114 of Section 4, Town of Springfield described as follows: Commencing at the Southwest corner of said Section 4; thence S89°25'54"East 403.50 feet to the point of beginning. Thence N01°52'37" East 737.22 feet; thence S88°59'58" East 439.61 feet; thence N00°13'52" East 533.00 feet; thence N89°34'04" West 215.12 feet; thence N41°41'53" West 88.99 feet; thence S89°34'04" East 675.59 feet; thence S00°13'52" West 650.00 feet; thence N89°34'04" West 335.00 feet; thence S00°13'52" West 687.05 feet; thence N89°25'54" West 526.76 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County, a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded suwey shall be submitted to Dane County Zoning. DEED ESTRICTION REQUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. [Note that the following deed restrictions apply to each C-2 parcel involved in this petition]. "The uses allowed in the C-2 rezone area,per Dane County Code of Ordinances section 10.14(1)include (a),(b),(c),(d),(e),(f), (g),(h),(i),(j),(m),(n),(o),(q), (r),(s),(t),(u), 1998. All uses identified as conditional uses per section 10.14(2)require a separate public hearing and town action" The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c).
