I've <br /> copied Steve Schulz, Chair of the BOA so that he is aware of this development. <br /> In addition, the proposed removing of the retaining wall will likely result in a violation of the DCCO due to our regulation <br /> of change of topography within 5 feet of a property line. The Town had originally put a <br /> condition on it stating that the part of the addition located on the corner of the building at Branch Road and Elder Lane <br /> needed to be cut at a 45 degree angle to preserve the vision corner. However, upon further review, the Town has <br /> amended that condition to say that the building addition can be squared off providing Mr. Bobek cuts the retaining wall <br /> located at that corner down approx. 2'. The exact amount required will be determined by the Town Chairman and Mr. <br /> Bobek.
