NULL & VOID: JULY 7, 2015 <br /> Dane County Board of Supervisors <br /> Amending Chapter 10 of the Dane County Code of Ordinances <br /> Zoning Map Amendment Petition 10719 <br /> Dane County Board of Supervisors does ordain as follows: <br /> The Zoning Districts Maps as referenced under Dane County Code of Ordinance <br /> Section 10.03 shall be amended as follows: <br /> Town Map: Town of Montrose Location: Section 9 <br /> Zoning District Boundary Changes <br /> A-1 EX to RH-2 <br /> A PART OF THE SE1/4 OF THE SW1/4 OF SECTION 9, T5N, R8E, TOWN OF MONTROSE, <br /> DANE COUNTY, WISCONSIN, MORE FULLY DESCRIBED AS FOLLOWS THE SOUTH 750 <br /> FEET OF THE SE1/4 OF THE SW1/4. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the <br /> Dane County Code of Ordinances. The rezoned area shall be subject to the <br /> following conditions. <br /> 1. The Certified Survey Map shall depict a "no build area" on the easterly 550 feet <br /> of Lot 1, the easterly 750 feet of Lot 2, and the easterly 850 feet of Lot 3. A <br /> note shall be added to the Certified Survey Map stating that, "Buildings are <br /> prohibited in the "no build area" as part of the condition of approval by Dane <br /> County Zoning and Land Regulation Committee under Zoning Petition #10719". <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County <br /> the owner or owners of the land record the following restriction(s) on said land: <br /> 1. A deed restriction shall be recorded on parcels 050809380010, <br /> 050809395000, 050809490020, and 050809495010 to prohibit further <br /> residential development on the remaining A-1 Exclusive zoned lands. The <br /> housing density rights have been exhausted on the original farm. <br />
