The newly created Transfer of Development Rights policies for the Town of Cross <br /> Plains will be used in order to facilitate the transfer. In addition, one driveway will be used to access these lots <br /> having three lots without street frontage. <br /> OBSERVATIONS: The proposed lots have been located in the wooded of the property. The proposed lots have <br /> slopes of approximately 16% grade around the outer borders. No other sensitive environmental features <br /> observed. <br /> TOWN PLAN: The property is located in the town's agricultural preservation district. <br /> RESOURCE PROTECTION: There are no areas of resource protection corridor located on the property. <br /> STAFF: The proposal complies with the town's TDR policies, and the proposed lots meet the dimensional <br /> standards of the RH-1 zoning district. If approved, Staff suggests that the approval be conditioned upon recording <br /> of a new CSM and shared driveway easement agreement in compliance with all applicable provisions of chapter <br /> 75. In addition, staff suggests that a Conservation Easement be recorded on the sending area farm; a Deed <br /> Notice be recorded that the identifies the transfer of development rights; and a deed restriction recorded on the <br /> remaining A-1 Exclusive"Prindiville" farmland to prohibit further residential development(housing density rights <br /> have been exhausted on the original farm). <br /> TOWN: Approved with no conditions. <br /> 3/11 ZLR Action: <br /> Motion by Bollig / Hendrick to recommend approval with conditions; motion carried, 5-0. YGP: 2-0. <br /> 1. The applicant shall be required to record a Certified Survey Map and shared driveway easement agreement in <br /> compliance with all applicable provisions of chapter 75. <br /> 2. A Conservation Easement prohibiting residential development shall be recorded on the sending area farms <br /> identifying the transfer of development rights (tax parcels: 0707-262-9560-1; 0707-262-8060-8; 0707-262- <br /> 9500-3; 0707-262-8000-0). <br /> 3. A Deed Notice shall be recorded on the CSM boundaries that identify the transfer of development rights. <br /> 4. A deed restriction shall be recorded on the parcels 0707-261-9500-4, 0707-252-8520-3, and 0707-252-9000-0 <br /> to prohibit further residential development on the remaining A-1 Exclusive zoned land. Housing density rights <br /> have been exhausted on the original farm. <br />
