The survey was required by Dane County Zoning in response to a written <br /> complaint received on June 18, 2015, stating erosion concerns and grading and excavating within 5 feet of a <br /> property line due to construction of a new agricultural accessory structure. <br /> A site inspection on June 18 observed grading and excavating had been done up to the adjacent property fence. In <br /> review of the plat of survey, it is evident that the adjacent property fence is located approximately six(6)feet east <br /> of the property line. The grading disturbance is in violation of the Dane County Code of Ordinances Section <br /> 10.04(6)(b)1. and encroaches on adjacent property. <br /> Dane County Code of Ordinances (DCCO) Section 10.04(6)(b)Standards <br /> 1.... the topography within five(5)feet of any property line at the commencement of any development <br /> shall remain unchanged. <br /> 2. a. When land disturbing activities associated with development occur within five(5) feet of any property <br /> line, finished grades in that area shall be restored to the topography in existence before the land disturbing <br /> activity began. <br /> 3.The established grade of the adjoining property shall determine the finished grade at the property line for <br /> any development. The owner of the property under development bears the burden of proof as to the <br /> established grade at the property line and the topography within five(5) feet of the property line. <br /> The Zoning Administrator may require detailed site grading plans of existing and proposed conditions to be <br /> submitted before commencement of land disturbing activities. <br />
