STATE OF WISCONSIN 1 1 SS BEFORE THE DANE COUNTY BOARD OF ADJUSTMENT COUNTY OF DANE ) A P P E A L cir The undersigned hereby represents that on the 21 st day of May 19j0 he applied to the Dane Cownty ZoninngSupervisor for a permit to conduct the East Side Business Men's Fall Festival on premises described as_that part of the SE's£ NB% of Section 5, which lies North of Mlilwaukee Street, which is zoned A-1 Agricultural Town of Blooming Grove , and that said permit was denied. The undersigned hereby appeals;to,the Dane County Board of Adjustment from the ruling of the Zoning Supervisor on the following grounds: It is our belief that unusual circumstances exist in this case for the following reasons: 1. This land has been used each of the last 15 years by the East Side Business Men's Association to conduct their annual festival. 2. Leases and contracts have been signed for the 1970 festival; some of these were made as early as the conclusion of the 1969 festival. 3. A recent interpretation of the Dane County Zoning Ordinance has held that such a use of land in the A-1 Agricultural District is not a permitted use. The petitioner asks relief in the form of a special exemption permit under 10.26 (3) 4. (b) of the Dane County Zoning Ordinance in order that previously made con- tractural agreements may be fulfilled. These agreements were made for in advance of the interpretation of the Zoning Ordinance.
