Lane, Roger
From: supervisor34 @gmail.com on behalf of Patrick Miles <Miles @CountyOfDane.com>
Sent: Friday,August 28, 2015 11:10 AM
To: Lane, Roger
Cc: Matano,Alfred; Bollig,Jerome; Kolar, Mary; Salov, Robert; Kostelic,Jeffrey;Wescott,
Joshua; Parisi,Joseph;Wegleitner, Heidi;Corrigan, Sharon
Subject: Re: FW: Letter and Motion from Attorney John Gerlach
Hello Roger,
I reviewed Attorney Gerlach's letter and the Town's motion requesting ZLR to delay the public hearing of CUP
2325 (Day Shelter at 1490 Martin St.). I understand they received the application July 30th and the town board
only had one meeting this month. While I appreciate that this may be a complicated and controversial issue for
the town board, I think the existing process allows plenty of time for them to review the material and seek
answers to questions and concerns they may have.
The public hearing is not until September 29th, a full two months after the receipt of the application. You may
want to point out to Attorney Gerlach and the town that 10.255(2)(c)of the county ordinance provides towns 60
days to inform the county its action on a CUP and also that they may submit a request to ZLR for an additional
40 days after that. It is the practice of the committee, by our committee rules, that we will not act on a petition
until we've received a report of the town's action(or until the time limit for the town to act has expired). Given
the existing time parameters, they will have had 161 days, more than 5 months, since the receipt of the
application to act. It is my opinion that this should be plenty of time for the town to gather the information they
need and provides them plenty of time to schedule special meetings, if need be. Therefore, the committee will
hold a public hearing on September 29th, as scheduled for this CUP.
Regards,
Patrick
On Thu, Aug 20, 2015 at 12:52 PM, Lane, Roger<lane.roger @countyofdane.com>wrote:
Dear Supervisor Miles,
Attorney Gerlach, representing the Town of Madison, would like the ZLR Committee to consider moving the public
hearing date for CUP 2325(Day Shelter at 1490 Martin Street)from September 29th to a later date. Any thoughts?
The Town has 60 days after the public hearing date to take action on the CUP.
We can move it to the October 27th Public Hearing date if you would like.
1
