NOTICE OF APPEAL <br /> 4:/0DANE COUNTY BOARD OF ADJUSTMENT <br /> (I) (WE) West Park Professional Offices hereby appeal to the Dane <br /> County Board of Adjustment from the decision of the Dane County Zoning Supervisor <br /> to deny a permit to construct a medium high-rise motel (65-70 ft. max. height) <br /> on the following described land West 658.85 ' of the NW 1/4/SW 1/4 lying <br /> between Seybold Road and Beltline Highway, Section 25 in <br /> the Town of Middleton which is located in the <br /> Dane County Zoning District. <br /> The permit was denied because 10. 11 (3) (b) of the Dane County Zoning Ordinance <br /> requires that the maximum building height be not over 4 stories <br /> The proposed building, addition or alteration will provide approximately <br /> 100 motel rooms . <br /> Strict application of the provisions of the ordinance would produce undue hardship <br /> because of the amount of land available for parking and the buildings ' <br /> aesthetics and future expansion . <br /> The hardship created is unique and not shared by all properties alike in the <br /> neighborhood because for C-2 commercial zoning the height allowable is <br /> 65 ft.
