The petition was postponed due to land division irregularities <br /> discovered on the parcel. <br /> It appears that the property was divided in 1982 without proper zoning or a certified survey map being <br /> prepared for the division. The created parcel was due to a partial fulfillment of a land contract recorded <br /> with the Dane County Register of Deed document#1747830. The property in its current state is in <br /> violation of Dane County Code of Ordinance Section 75.09. <br /> With further investigation, it appears that the existing residence was constructed on the property as part <br /> of a farm operation under Farm Plan #9. It appears that the farm operation had never started or has <br /> ceased. The farm plan statement of understanding requires that land owner rezone the property for a <br /> residence if the farm operation has terminated. Given the farm operation has ceased, Dane County <br /> Zoning is considering the house in violation of Dane County Code of Ordinances. Single family <br /> dwellings are not a permitted by right in the A-1 Exclusive Agriculture Zoning District as described <br /> under Dane County Code of Ordinances Section 10.123. The residence located on the property is in <br /> violation of the Dane County Code of Ordinances. <br /> In order to correct the violations on the property and continue the zoning petition process, the petition <br /> will need to be revised to include the portion of land that is in violation with the Dane County Code of <br /> Ordinances. The proposed certified survey map shall be revised to create a lot around the residence. <br /> The boundaries of the proposed lot shall be added to the petition zoning petition.
