Hooey - Westport - 3/27/86 - public hearing. <br /> The Board allowed presentations from Attorney Mark Zimmer, representing Mr. <br /> Hooey, and Zoning Administrator William Fleck. <br /> Kruschke/Schwahn to deny variance from required setback from normal high <br /> waterline to allow deck as constructed. <br /> FINDING OF FACT: <br /> 1) . Deck was constructed without required zoning permit. <br /> 2) . Granting of variance would have the effect of determining setback from <br /> normal high waterline for adjoining properties as per S-11.03 (2) - Dane <br /> County Zoning Ordinance. This could result in reduced setback <br /> progressively along the shoreline. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> 2) . Variance would set an unwarranted precedent. <br /> Motion carried - 4-1. (Miller - no) . <br /> #1441.
