Appeal by Darrell Holcomb&David Oberg for a variance from required lot width and lot
area as provided by Sections 10.05(4)and 11.03(1)to permit lot reconfiguration by Certified
Survey Map at 118 Maple Street being Lots 9 through 13,Block 9,Edgerton Beach Park-Section
25,Town of Albion.
FACTS OF THE CASE
The applicant seeks a variance to reduce the minimum required lot width of 100 feet to 95.88 feet
(lot 1)and 67.04 feet(lot 2)thus requiring variances of 4.12 feet for lot 1 and 32.96 for lot 2.A
variance is also required to reduce the minimum lot area of 15, 000 square feet to 11, 986 SQ.feet
(lot 1)and 8,371 SQ. feet thus requiring a variance of 3,014 SQ. feet for lot 1 and 6, 629 SQ.feet
for lot 2.The applicant appeared before the Board for a sideyard variance and was subsequently
denied. He then purchased additional land from the adjacent property owner thereby negating the
need for the variance. However in the process he had adjusted the property lines which required the
filing and recording of Certified Survey Map. In order for the Land Division Review Officer to
approve the proposed CSM Board of Adjustment approval is needed on the variances.
#3020. Appeal by Denny&Kathy Layton for a variance from required setback from road as
provided by Section 10.17(1)to permit alteration/addition to existing residence at 335 State
Highway 106 in the NE 1/4 SE 1/4-Section 23,Town of Albion.
FACTS OF THE CASE
The applicant seeks a variance to reduce the minimum required setback of 100' from the centerline
of STH 106 44 feet thus requiring a variance of 56 feet. The purpose of the variance request is an
addition of a proposed 8'x16'porch.Although the proposed porch addition is not encroaching any
further into the setback than the existing residence there is an alternative location for the placement
of the proposed porch without requiring a variance from the Board. The property line along
Hillside Road could be considered the front property line thus allowing a minimum side yard
setback of 10 feet to the south of the house which would provide an adequate area for the proposed
porch.
#3021. Appeal by Donald&Diane Martinson for a variance from required setback from normal
high watermark as provided Section 11.03(2)to permit addition to existing residence at 4181 Vilas
Road in the NE 1/4 NE 1/4-Section 17,Town of Cottage Grove.
FACTS OF THE CASE
The applicant seeks a variance to reduce the minimum required setback of 75 feet to the normal
highwater mark of a tributary to Little Door Creek to 56 feet thus requiring a variance of 19 feet.
The purpose of the variance request is to construct a two story addition to the residence and a
proposed deck and stairs. The tributary in question appears to be no more than maybe a drainage
ditch probably retaining water during the spring runoff only. In addition in this particular there
does not appear to be any other location on the property for the proposed construction.
#3022. Appeal by Kevin&Cindy Lee for a variance from required side&rearyards as provided
by Sections 10.07(7)and(8)and 10.16(5)to permit structural repair of existing residence at 99
