Appeal by Kelley Williamson Company for a variance from required setback from
road as provided by Section 10.17(2)to permit underground fuel storage tanks at 5418
Bluebill Park Drive being Lot 1 and part Lot 2, CSM#324 in the NW 1/4 SE 1/4 Section
22, Town of Westport.
FACTS OF THE CASE
The applicant seeks a variance to reduce the minimum required setback of 42' from the right-of-
way of County Trunk Highway"M"to 10 feet thus requiring a variance of 32 feet. The purpose
of the variance request is to allow for the placement of underground storage tanks. The Board over
a period of time has approved and denied cases involving underground fuel storage tanks. These
actions by the Board have been based upon facts and circumstances involving the individuals
appeals. Although this is a variance request to the right-of-way of County Trunk Highway"M"
the actual distance to the pavement of CTH"M"is estimated at approximately 150-200 feet. Staff
foresees no apparent problem unless consideration were given to a north beltline corridor.
