DANE COUNTY ORDINANCE AMENDMENT NO. 8785 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of York. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of York be amended to include in the RH-1 Rural Homes District/s the <br /> following described land: <br /> PETITION NUMBER: 8785 <br /> Part of the E 1/2 of the NE 1/4 of Section 19, Town of York described as follows: <br /> Commencing at the Northeast corner of said Section 19, Town of York, thence South 4.30 <br /> feet;thence along the centerline of Janisch Road, 1540 feet to the point of beginning;thence <br /> S45°East 480 feet;thence S45° West, 800 feet;thence North along the West line of the <br /> E 1/2 NE 1/4, 720 feet to the centerline of said Janisch Road; thence N55° East along said <br /> centerline, 135 feet; thence N45° East along said centerline, 165 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2. (b)Of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> i <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the <br /> owner or owners of the land shall record the following restrictions on said land: <br /> 1) Deed Restrict the balance of the property to prohibit further residential <br /> development(parcel numbers 0912-191-8070; 0912-191-8000; 0912-191-9500; <br /> and 0912-191-9570). <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as <br /> the owners of land within 300 feet of the site. Failure to record the restrictions will cause <br /> the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description's is/are intended to describe land for which a certified survey <br /> map will be prepared for approval and recorded. This amendment will become effective, if <br /> within 90 days of its approval by Dane County, a certified survey map that describes the <br /> land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure <br /> to record the survey will cause the rezone to be null and void.
