DANE COUNTY ORDINANCE AMENDMENT NO: 9749 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Sun Prairie. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps <br /> of the Town of Sun Prairie be amended to include in the C-2 Commercial districts)following <br /> described land: <br /> PETITION NUMBER: 9749 <br /> C-2 <br /> Part of the Southeast 114 of the Southwest 1/4 of Section 32,Township 8 North,Range 11 East, <br /> Town of Sun Prairie,Dane County,Wisconsin,described as follows: Beginning at the <br /> intersection of the East line of the Southwest 114 of said Section 32 and the center line of the <br /> present concrete pavement of new State Highway No. 30;thence North 88 degrees 30' West <br /> along said present concrete highway center line 1169.8 feet;thence South 3 degrees 25'West <br /> 136.0 feet to the South line of new State Highway No. 30 and the point of beginning of this <br /> description;thence continue South 3 degrees 25' West 171.0 feet;thence South 89 degrees 46' <br /> East 264.6 feet;thence North 3 degrees 25'East 146.0 feet to the South line of new State <br /> Highway No. 30;thence North 88 degrees 30'West along said South line of highway,50.8 feet; <br /> thence North 3 degrees 25'East along highway right of way line 20.0 feet;thence North 88 <br /> degrees 30'West 213.8 feet along South line of highway to the point of beginning.Also all land <br /> between the South line of new State Highway No. 30 and the North line of the Southeast 114 of <br /> the Southwest 114 of Section 32 and between the East and West boundaries of above described <br /> parcel extended. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County <br /> Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the owner or <br /> owners of the land record the following restriction(s)on said land: <br /> 1. Deed restriction shall be recorded to limit the land uses to warehousing and storage incidental <br /> to principal use,offices,woodworking shops,machine shops,manufacturing/assembly <br /> plants,bicycle sales and repairs,rental businesses(except motor vehicle),sales and repair of <br /> lawn and garden equipment,major repairs to motor vehicles,sales of new and used vehicles, <br /> sales of new and used recreational equipment. <br /> 2. Deed restriction shall be recorded to restrict the hours of operation to 5am to 10pm and <br /> outdoor lighting on the property shall not be a nuisance to the neighboring property. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon Their fmdings,to be consistent <br /> with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
