WI. <br /> Legal Description: Attached <br /> We are requesting a conditional use permit in connection with the code section 10.11 (3) (h) <br /> "Recreational facilities affiliated with a permitted B-1 use and lighted to operate at night". <br /> The reasons we feel this conditional use should be granted are: <br /> A. Rookies Food and Spirits is a family friendly establishment which, in the rear yard, <br /> features a small version of a baseball park complete with bases,a non-operating <br /> scoreboard, wooden home run fence and lights.While it is too small and not intended <br /> for organized softball,whiffle balls and bats are provided for occasional use by <br /> adults and their children. <br /> B. The existing use of the properties to the north, south and west is agricultural. A residence <br /> exists to the east. <br /> C. Time schedule: The rear yard is presently developed. <br /> D. The property slopes to the rear yard and so the "baseball" field is about ten feet lower <br /> than highway 14 and the residential property to the east therefore lessening it's visual <br /> impact. The field is complimentary to the family friendly image the owners wish to <br /> project. <br /> E.
