DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> STAFF REPORT <br /> Petition No. 7435—Mitchell Grundahl Public Hearing Date: 12/15/98 <br /> Section 36, Town of York Work Meeting: 1/12/99 <br /> I. BACKGROUND <br /> A. Request <br /> The applicant is requesting to divide and rezone a 9.6-acre, non-conforming, A-1 Exclusive <br /> parcel into two lots. Lot 1 will be 2.2 acres, and it will be rezoned to A-2 (1). It will be <br /> connected to a 7 acre parcel in Dodge County. The intent is to provide access to a future single- <br /> family residential site in Dodge County. No building is intended for Lot 1 in Dane County; the <br /> applicant only intends to put a driveway across it. Lot 2 will be 7.4 acres, and it will be rezoned <br /> to RH-2. This lot includes the applicant's residence, which also appears to be the original <br /> farmstead. Attachment A depicts the proposed lot configuration. <br /> B. Site/Locational Information <br /> The parcel in question sits in Section 36 of the town of York, immediately on the line between <br /> Dane and Dodge Counties. There does not appear to be any physical complication of the site <br /> (e.g. slope,wetland/floodplain, hydric soil, etc.). <br /> C. Other Approvals Required <br /> The town of York will likely need to issue a driveway permit for access onto Broetzman Road. <br /> II. ANALYSIS <br /> A. Compliance with Adopted Plans <br /> Dane County Regional Planning indicates that, "...this petition appears reasonably consistent <br /> with adopted plan policies." <br /> The density analysis indicates that the original farm, at the time of town plan adoption in 1979, <br /> was comprised of 48 acres. Based on the town's one per 35 acre density policy, this would allow <br /> one split. There have been no previous splits. Regional Planning astutely points out the fact that <br /> per the town of York's policy,' the applicant may be allowed to create an additional residential lot <br /> in Dane County. With the imposition of a deed restriction on Lot 1, will the applicant be allowed <br /> one additional building site on another lot at some point in the future? Does the town of York <br /> count a split for the original farmstead against the total number of splits allowed? Either way, it <br /> appears that the applicant may pursue the current proposal.
