DANE COUNTY ORDINANCE A P,I ENDMENT NO. 7435 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of York. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of York be amended to include in the RH-2 Rural Homes and A-2(1) <br /> Agricultural District/s the following described land: <br /> PETITION NUMBER: 7435 <br /> TO A-2(1): <br /> Part of the SE 1/4 of the NE 1/4 of Section 36, Town of York described as follows: <br /> Commencing at the Northeast corner of said Section 36; thence South along the East line <br /> of the Northeast quarter, 1336.95 feet to the point of beginning; thence continue South <br /> along said East line of the Northeast quarter, 261.6 feet; thence West 351.54 feet to the <br /> center of Broetzman Road; thence North along said centerline 261.6 feet; thence East <br /> along the North line of said SE 1/4 of the NE 1/4, 351.54 feet to the point of beginning. <br /> TO RH-2: <br /> Part of the SE 1/4 of the NE 1/4 of Section 36, Town of York described as follows: <br /> Commencing at the Northeast corner of said Section 36; thence South, 1598.55 feet along <br /> the East line of said Northeast quarter to the point of beginning; thence continue South <br /> along the East line of said Northeast quarter, 760.69 feet; thence West, 453.83 feet; <br /> thence North, 760.55 feet; thence East, 458.47 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register ofDeeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. That there shall be no residential development on the A-2(1)rezone area and no further residential <br /> development on parcel 0912-361-9500. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owner if <br /> land within 300 feet of the site.
