DANE COUNTY ORDINANCE A P,I ENDMENT NO. 7435 Amending Section 10.03 relating to Zoning Districts in the Town of York. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of York be amended to include in the RH-2 Rural Homes and A-2(1) Agricultural District/s the following described land: PETITION NUMBER: 7435 TO A-2(1): Part of the SE 1/4 of the NE 1/4 of Section 36, Town of York described as follows: Commencing at the Northeast corner of said Section 36; thence South along the East line of the Northeast quarter, 1336.95 feet to the point of beginning; thence continue South along said East line of the Northeast quarter, 261.6 feet; thence West 351.54 feet to the center of Broetzman Road; thence North along said centerline 261.6 feet; thence East along the North line of said SE 1/4 of the NE 1/4, 351.54 feet to the point of beginning. TO RH-2: Part of the SE 1/4 of the NE 1/4 of Section 36, Town of York described as follows: Commencing at the Northeast corner of said Section 36; thence South, 1598.55 feet along the East line of said Northeast quarter to the point of beginning; thence continue South along the East line of said Northeast quarter, 760.69 feet; thence West, 453.83 feet; thence North, 760.55 feet; thence East, 458.47 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County, a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register ofDeeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. That there shall be no residential development on the A-2(1)rezone area and no further residential development on parcel 0912-361-9500. Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owner if land within 300 feet of the site.
