MEMO DATE: December 1, 1998 TO: Ruth Klahn, Clerk Town of Oregon, Board Members Dane County Zoning and Natural Resources Committee FROM: Monica Slaght, Chair-Town of Oregon Plan Commission RE: Rezone Petition#7438 4 C, -P 1533 The Petitioner submitted paperwork for rezone petition #7438, which was noticed for a public hearing on November 24, 1998. The Petitioner's original request was for a rezone to allow a veterinary clinic, which is a permited use under the C-1 category. The Petitioner has made a change request and would like to proceed with a rezone and CUP to allow a veterinary hospital and boarding facility on the property. Since the Public Hearing on the 24th was not noticed for a CUP- action was deferred-and will be taken up at a Public Hearing on Monday, December 14th. The Petitioner attended the November 24th meeting and was in agreement to defer to the December Public Hearing and Plan Commission meeting. The Plan Commission will make their recommendations prior to the County meeting-although the Town Board approval will still be required at the January meeting. Resident concerns, expressed by letters and by those present at the Public Hearing, suggested that they were not opposed to the rezone or the facility itself-but rather concerned about traffic, noise, etc. that the facility could generate. The Petitioner has stated a desire to be considerate of the concerns of surrounding residential properties. Also, in discussing the proposed CUP for the site, concerns were expressed related to allowed uses for a C-1 rezone- should the facility change owners and uses in the future. These concerns have been addressed by the following restrictive covenants being placed on the rezone. The Plan Commission recommends approval of the rezone to C-1, Section 10.13 of the Dane County Ordinance, to allow the following uses for the Petitioner's veterinary hospital and boarding kennel,with restrictive covenants being a condition of approval-to restrict other uses which may not be compatible with a rural agricultural/farming community, such as the Town of Oregon. /The rezone to the C-1 zoning district for Petition # 7438 be limited to- `7* Subsection 10.13 (1) (d) Medical, dental and veterinary clinics •--•-' = a"' 1 - :°s '" �• G. read.,-d� C tj- -c - am,+,•,.L2 �.LO-1 .
