DANE COUNTY ORDINANCE AMENDMENT NO. 7280 Amending Section 10.03 relating to Zoning Districts in the Town of Westport. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Westport be amended to include in the A-B Agricultural Business District/s the following described land: PETITION NUMBER: 7280 A parcel of land located in the NW 1/4 of the NW 1/4 of Section 29, Town of Westport described as follows: Beginning at the intersection of the East line of said NW 1/4 of the NW 1/4 and the Southerly right-of-way of CTH K; thence South 225 feet; thence West 390 feet; thence North 225 feet; thence East 390 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed descriptions is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County, a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1.Restricted to proposed use of agricultural trucking. 2.Require inside strorage of all vehicles and equipment. 3.No further subdivision of the two lot as shown on the attached preliminary survey. 4. Require reclamation plan for existing quarry located on proposed lot 1 as shown on the preliminary survey. 5. A drainage easement should be provided from the outlet of the 24' CMP to the south property line following the natural drainage course 20 feet wide or all wetland,whichever is greater. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. A copy of the recorded document shall be submitted to Dane Coun: mooning, The rezoned area shall be subject to the following cond.:ons. 1. Delayed effective date.
