DANE COUNTY ORDINANCE AMENDMENT NO. 7417 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Medina. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Medina be amended to include in the RH-3 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 7417 <br /> Parts of the NW 1/4 of the NE 1/4, and the SW 1/4 of the NE 1/4, all in Section 28 Town <br /> of Medina described as follows: Commencing at the North quarter corner of Section 28; <br /> thence N86°12'00" East along the North line of the NW 1/4 of the NE 1/4, 440 feet to <br /> the point of beginning;thence continue N86°12' East, 365 feet; thence South, 1315 feet to <br /> the centerline of Sherman Drive; thence East along said centerline, 800 feet; thence South, <br /> 320 feet; thence West, 1260 feet; thence N50° West, 217 feet; thence North, 190 feet to <br /> the aforesaid centerline of Sherman Drive, thence East along said centerline, 75 feet to the <br /> Southeast corner of Dane County Certified Survey Map #2050, thence NO2°44' West <br /> along the East line of said Certified Survey, 397 feet; thence N86°12' East, 231 feet; <br /> thence North, 916 feet to the point of beginning <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed descriptions is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. That the balance of parcels 0812-281-8040-6, 0812-281-8500-9, 0812-281-9000-2 and 0812-281-9500- <br /> 7(lying west of State Highway`731,shall be restricted to no further residential development or splits. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site.
