P pec Gg <br /> • <br /> Development Agreement <br /> THIS AGREEMENT, made and entered into by and between the Town of Windsor, a body <br /> corporate and politic (the "Town") and David R. Bouril (the "Developer"). <br /> WITNESSETH: <br /> WHEREAS, Developer owns and is promoting the development of property within the Town; <br /> and <br /> WHEREAS, Developer has received approval of zoning and approval of a Preliminary Certified <br /> Survey Map, or development plan, from the Town for lands located at 4505 Windsor Road, and <br /> as attached hereto as Exhibits A and A-1 (the "Subject Realty"); and <br /> WHEREAS, Developer intends to develop and improve the Subject Realty in conformance with <br /> approved Preliminary CSM; and <br /> WHEREAS, the Town's Land Division and Subdivision Control Ordinances require among <br /> other things that as a condition of approval, a developer construct to Town standards and <br /> dedicate to the Town, at no cost, all necessary public improvement required by,the Town. <br /> Further, the Town's policy on Special Assessments and Charges states that reconstruction and <br /> widening of streets in a commercial/industrial area is entirely assessable to the adjoining <br /> property; and <br /> WHEREAS, the Town's Land Division and Subdivision Control Ordinances and related <br /> ordinances require that existing public improvements to be modified and new public <br /> improvements to be completed in order to adequately convey storm water runoff, control erosion <br /> and prevent siltation of surface waters, provide for adequate potable water for consumption and <br /> fire protection, provide adequate sanitation, provide for adequate and appropriate public space, <br /> and provide for safe traffic movement, to serve proposed building site(s) and to maintain and <br /> enhance the quality of life in the Town; and <br /> WHEREAS, Developer has paid all fees and charges required by the Town and has reimbursed <br /> the Town for all expenses incurred by the Town for the review and approval of the conceptual <br /> plan, preliminary plat or preliminary CSM, and/or rezoning of the Subject Realty; and <br /> WHEREAS, Developer has indicated that it has the capability to complete the necessary public <br /> improvements and has made the necessary applications to the Town for approval of a Final CSM <br /> for all or part of the Subject Realty; <br /> NOW, THEREFORE, in consideration of the covenants hereinafter set forth, and other good <br /> Bouril CSM Agreement 02/04/99 Page 1 <br />
