f. Developer shall make and install all required public improvements in <br /> conformance with this Agreement and as determined by the Town Engineer. <br /> 3. Utilities. The Developer shall be responsible for making all arrangements with the <br /> appropriate utility services for necessary installation, disconnections, reconnections, and <br /> relocations of their facilities, as may be required for the completion of the improvements <br /> pursuant to this Agreement. <br /> 4. Conditions Precedent to Approval and Execution of a Final CSM. The Town shall <br /> not approve the Final CSM for any portion of the Subject Realty prior to the time that: <br /> a. The Town Board, after a recommendation by the Town Plan Commission, finds <br /> that the Final CSM is in conformity with the approved Preliminary CSM. <br /> b. Developer has paid all fees and charges required by the Town and has reimbursed <br /> the Town for all expenses incurred by the Town for the review and approval of the <br /> Final CSM. <br /> c. Developer has obtained all necessary federal, state, county, and local agency <br /> permits and approvals. <br /> 5. Conditions Precedent Construction of Public Improvements. The Town shall not <br /> issue any construction or grading permits for public improvements pr/ior.to the time that: <br /> a. Developer has recorded the Final CSM <br /> b. The Town Engineer has approved Plans and Specifications for required public <br /> improvements (including reconstruction of existing public improvements) in <br /> compliance with the Town's Land Division and Subdivision Control Ordinances <br /> and other development related ordinances and has notified the Town Board of <br /> such approval. <br /> c. The Town Engineer has approved and inspected required traffic regulation and <br /> control improvements or plans to be implemented by the Developer during the <br /> construction. <br /> d. Contractor(s) selected by the Developer to construct said public improvements has <br /> provided a Certificate of Insurance to the Town naming the Town of Windsor as <br /> an additional insured for general liability in the amounts of$1,000,000 individual <br /> bodily injury or death, and $3,000,000 single accident, and $1,000,000 property <br /> damage. <br /> e. The Town Code Enforcement Officer has determined that Developer has installed <br /> the soil erosion and sedimentation controls required by the Dane County Land <br /> Conservation Department as provided in the approved Plans and Specifications. <br /> Bouril CSM Agreement 02/04/99 Page 3 <br />
