Town will release the security to the Developer upon the expiration of the <br /> guarantee period. <br /> e. During the guarantee period, the Town shall provide routine snow and ice <br /> removal services on dedicated public streets but shall not be responsible for <br /> incidental damage to road surfaces or curb caused by reasonable performance of <br /> such service. <br /> 7. Building Permits. <br /> a. The Town shall not issue any permit for grading or construction on any lot <br /> included within the Final CSM prior to such time that: <br /> i. The Developer has deposited the security as described herein and the <br /> required public improvements are under construction. <br /> ii. The Town Code Enforcement Officer determines that there is adequate <br /> access to the lot for emergency vehicles, and inspects and approves the <br /> required on-lot soil erosion and sedimentation controls approved Dane <br /> County Land Conservation. <br /> iii. Developer has obtained a grading and/or construction permit from the <br /> Town. <br /> b. Developer shall comply in all respects to the Town's Building Codes, and other <br /> construction regulations of the State of Wisconsin and Dane County, as may be <br /> applicable. <br /> c. The Town shall not permit any occupancy of any structure constructed in the <br /> Subject Realty prior to the Town Code Enforcement Officer's inspection and <br /> approval of the construction, and the Town Engineer's approval of the public <br /> improvements. <br /> 8. Agreement for Public Water and Sewer. Developer shall execute an agreement with <br /> Windsor Sanitary District #1 pertaining to the extension and connection to public water <br /> and sanitary sewer facilities to serve the Subject Realty. <br /> 9. Special Provisions. <br /> a. Development/Redevelopment of Lot 3 shall be in conformance to the Town's <br /> Land Use Plan that is in effect at the time that such development is proposed. <br /> Development of Lot 3 shall require the improvement of the Windsor Road <br /> frontage (pavement, curb, gutter, sidewalk, street trees) and the extension and <br /> connection of Traveler Trail/Melwood Lane to Windsor Road.. <br /> b. The following landscaping is required in the front yard area of Lots 1 & 2 and <br /> shall be planted as a condition of occupancy of the building: <br /> Bovril CSM Agreement 02/04/99 Page 5 <br />
