• <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 7410 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Black Earth. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Black Earth be amended to include in the RH-3 Rural Homes <br /> District/s the following described land: <br /> PETITION NUMBER: 7410 <br /> A parcel of land in the NE 1/4 NE 1/4, the SE 1/4 NE 1/4, the SW 1/4 NE 1/4, the NW <br /> 1/4 NE 1/4, Section 21, Town of Black Earth, described as follows: Commencing at the <br /> Northeast corner of said Section 21; thence S00°19'20" East,737.44 feet; thence <br /> S69°43'00" West, 949.71 feet to the point of beginning; thence South 41° 00'00" East, <br /> 398.35 feet; thence S29°20'27' West, 259.35 feet; thence S61°21'27" West, 228.02 feet; <br /> thence S63°37'23" West, 276.59 feet; thence N33°29'08" West, 759.73 feet; thence <br /> N81°46'38" East, 653.46 feet; thence N69°43'00" East, 91.77 feet to the point of <br /> beginning. Also: Lot #1, CSM 6869 found in Volume 23, Page 156 of Certified Survey <br /> Maps Dane County Register of Deeds Office. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED ED SURVEY REOUI ED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.To prohibit further development on the rezone area. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
