C. Site/Locational Information <br /> The property is located in the northeast and northwest quarters of Section 26, in the Town of <br /> Roxbury, approximately 2/3 of a mile north of the intersection of Breunig Road and U.S. <br /> Highway 12. The proposed 5-acre RH-2 lot would have 66 feet of frontage on the east side of <br /> Breunig Road. The property is in a rural area, roughly 2.25 miles southeast of Roxbury hamlet. <br /> D. Other federal, state, county or local approvals required <br /> A Certified Survey Map meeting the minimum standards of both the Dane County Subdivision <br /> Ordinance (Chapter 75, Dane County Code) and the Town of Roxbury Subdivision Ordinance <br /> must be recorded in the Register of Deeds before the land can be sold. A delayed effective date <br /> has been requested to accommodate CSM approval. <br /> Because the area associated with the proposed driveway alone would exceed 4,000 square feet, <br /> County Erosion Control Permits under Chapter 14 of the Dane County Code will be required <br /> before earthmoving or grading take place. Chapter 14 permits require an Erosion Control Plan <br /> approved by the Dane County Land Conservation Department. <br /> County zoning permits, sanitary permits and certificates of compliance will also be necessary <br /> before buildings can be constructed or occupied. Town driveway and/or building permits may <br /> also apply. <br /> II. ANALYSIS <br /> A. Compliance with Adopted Plans <br /> Town/County Farmland Preservation Plan <br /> The Town of Roxbury Land Use Plan/Dane County Farmland Preservation Plan (last amended <br /> in 1993) shows the property in an Agricultural Preservation Area. Within such areas, the town <br /> and the county have adopted the following relevant policies: <br /> • Limit non farm residential development to those areas with soils not classified as prime <br /> farmland or those of statewide importance; <br /> • Roads or driveways not permitted to cross agricultural land to reach proposed non farm <br /> development. <br /> According to the Dane County Soil Survey (1978) the soils under the proposed five acre RH-2 lot <br /> and driveway are a mixture of McHenry (MdD2) silt loams, Kidder(KdD2) and Whalan <br /> (WwE2) loams, none of which are classified as prime or state-significant soils. The Soil Survey <br /> suggests that all three of these soil types are better suited for grazing or woodland than for row <br /> crops, due to their low fertility and erosion potential. <br /> Farm plans filed with the Dane County Land Conservation Department show the northern <br /> portion of the Breunigs' land (including the existing field road) as rotational cropland. Because <br /> of their scale, LCD farm plans typically do not distinguish small areas of non-tillable land, such <br /> as roads, from surrounding cropland.
