COMPROMISE AGREEMENT—JCL CONDOMINIUMS <br /> WHEREAS, Petition 10755 was filed with the Dane County Zoning Department seeking to <br /> amend the zoning applicable to a Condominium Plat, by the amendment of deed restrictions; <br /> WHEREAS, the Town Board for the Town of Christiana approved a Resolution to Amend <br /> Zoning District Classification ("Christiana Resolution") on April 23, 2015, a true and correct <br /> copy of which is attached hereto, and incorporated herein,as Exhibit A; <br /> WHEREAS, the Dane County Board, on May 21, 2015, upon the recommendation of the Dane <br /> County ZLR Committee, approved Petition 10755, subject to the terms and conditions within the <br /> Christiana Resolution; <br /> WHEREAS, the attached Condo Plat (Exhibit B) designates the Condominium Units referenced <br /> herein; and <br /> WHEREAS, the following agreements are hereby entered into in compliance with the Christiana <br /> Resolution; <br /> NOW THEREFORE,the parties identified herein agree as follows: <br /> 1. The Board of Directors or "Manager" of the JCL Condominium Association and Jolly <br /> Rogers of Cambridge, LLC, and the Town of Christiana and Dane County, hereby <br /> stipulate and agree: <br /> a. That the occupants of Unit #1 were in violation of the previously recorded deed <br /> restrictions for the property, which violation will be cured by compliance with the <br /> Christiana Resolution; <br /> b. The coffee warehousing business found within Unit #1 may remain lawfully in <br /> operation at said Unit #1 for so long as the current coffee warehousing business <br /> remains an ongoing concern.
