• <br /> COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> ZONING REVIEW <br /> 16. 7397 Midthun Brothers do Thomas Midthun,Vienna 26 <br /> A-1EX Deed Restricted to R-1A <br /> Thomas Midthun wishes to build a home on 1.2 acres of the 320 acre Midthun Brothers farm. The <br /> proposed 1.2 acre parcel is located in a 63.5 acre portion of the farm which was recently purchased by <br /> the Midthuns from Russell Leonard,and which lies just North of Lot 1, CSM 8052. Lot 1, CSM 8052 <br /> was created when Leonard rezoned 6.4 acres from A-1EX to RH-2. The Town of Vienna required <br /> Leonard to restrict his remaining 63.5 acres from any further development by recording the following <br /> Deed Restriction: <br /> 1.Prohibit any further building development on the property from which the parcel is split;the <br /> legal description of said parcel is to be identified in the <br /> restrictive covenant. <br /> That is,building was prohibited on the 33.6 acres in the"SW 1/4 NW 1/4 Section 26 Town of Vienna <br /> except Lot#1 CSM 8055," which is the parcel on which Thomas Midthun wishes to build,if he can <br /> get the Deed Restriction removed. <br /> Midthun Brothers are willing to extend the"no further development"restriction to include <br /> their entire remaining 62.3 acres of land. The Town of Vienna has agreed to the following new Deed <br /> Restriction language: <br /> 1. Prohibit any further residential building development on the parcel from which the R-1A <br /> parcel is split(currently identified as Tax Parcel Number 34-0909-262-9001-9 located in the <br /> SW 1/4 NW 1/4 Section 26,Town of Vienna.) The legal description of said parcel is to be <br /> identified in the restrictive covenant; <br /> and <br /> 2. Prohibit any further residential building development on Tax Parcel Number 32-0909-262- <br /> 9540-7 described as"The West 30 acres of the SE 1/4 NW 1/4 Section 26,Town of Vienna." <br /> Soils: 100%Class I-II <br /> Uses: 100%Cropland <br /> REGIONAL PLANNING <br /> Petition 7397. Pending further comments at the public hearing,this petition appears reasonably <br /> consistent with adopted plan policies. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> None <br /> DANE COUNTY HIGHWAY <br /> Petition 7397. CTH "I" is not a controlled access highway. Joint use accesses will be required where <br /> possible. An access permit is required for new points of access and changes in use of existing access <br /> points. <br /> OTHER <br />
