Page 3 13. There shall be no bulk fuel stored on the site. 14.No water shall be removed from the site in order to maintain groundwater discharge to adjacent areas. 15. The operator shall use water spray bars in the crushing process to reduce dust as necessary. Use of spray bars is not required when the temperature is below freezing. The operator shall spray the site with water if and when needed to control dust. 16. The operator shall require all trucks, excavation, crushing, screening and washing equipment to have muffler systems which meet or exceed the current industry standards for noise abatement. 17. If the Highway Commissioner determines that improvements to the intersection of the access road and CTH N are necessary as result of the mineral extraction operation, the operator shall improve such intersection at its expense to the specifications of the Highway Commissioner. The operator shall not be responsible for improvements associated with the planned reconstruction of CTH N. 18. The CUP site shall occupy 15 acres only. 19. The letter dated August 6, 1998 from Aicardo Roa shall reflect in item# 1 that the entrance tracking pad shall be 20' x 150' x 12" of 6" and not 12 feet. THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING AND IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE FOLLOWING FINDING OF FACT: 1 . That the establishment, maintenance and operation of the proposed conditional use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare. 2. That the uses, values and enjoyment of other property in the neighborhood for purposes already permitted will not be substantially impaired or diminished by the establishment, maintenance and operation of the proposed conditional use. 3. That the establishment of the proposed conditional use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district. •
