Page 3 <br /> 13. There shall be no bulk fuel stored on the site. <br /> 14.No water shall be removed from the site in order to maintain groundwater discharge to <br /> adjacent areas. <br /> 15. The operator shall use water spray bars in the crushing process to reduce dust as necessary. <br /> Use of spray bars is not required when the temperature is below freezing. The operator shall <br /> spray the site with water if and when needed to control dust. <br /> 16. The operator shall require all trucks, excavation, crushing, screening and washing equipment <br /> to have muffler systems which meet or exceed the current industry standards for noise abatement. <br /> 17. If the Highway Commissioner determines that improvements to the intersection of the access <br /> road and CTH N are necessary as result of the mineral extraction operation, the operator shall <br /> improve such intersection at its expense to the specifications of the Highway Commissioner. The <br /> operator shall not be responsible for improvements associated with the planned reconstruction of <br /> CTH N. <br /> 18. The CUP site shall occupy 15 acres only. <br /> 19. The letter dated August 6, 1998 from Aicardo Roa shall reflect in item# 1 that the entrance <br /> tracking pad shall be 20' x 150' x 12" of 6" and not 12 feet. <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING AND <br /> IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE <br /> FOLLOWING FINDING OF FACT: <br /> 1 . That the establishment, maintenance and operation of the <br /> proposed conditional use will not be detrimental to or endanger <br /> the public health, safety, morals, comfort or general welfare. <br /> 2. That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, <br /> maintenance and operation of the proposed conditional use. <br /> 3. That the establishment of the proposed conditional use will not <br /> impede the normal and orderly development and improvement of <br /> the surrounding property for uses permitted in the district. <br /> • <br />
