COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> ZONING REVIEW <br /> 14. 7395 Karen Gates(Troy Gates,agent-son),York 18 <br /> C-2 to RH-1 and RH-2 <br /> HISTORY: <br /> 1990: 1.4 acres of this 10 acre parcel(Lot 1, CSM 2880)was rezoned to from A-1EX to C-2(Pet <br /> 4679, effective 04/27/1990)for a commercial auto body repair operation with the following Deed <br /> Restriction: <br /> Commercial use of the property is limited to the following: <br /> 1. Repair of automobiles <br /> 2. Sale of auto parts,oils,fluids, etc.,required for the repair of said vehicles. <br /> 1992: The entire 10 acres was rezoned to C-2, with no Deed Restrictions(Pet 5396, effective <br /> 08/26/1992.) Note: This rendered the above Deed Restrictions `void." <br /> 1995: A Conditional Use Permit for a"residence for a watchman or caretaker"was granted(CUP <br /> 1247, effective 06/27/1995.) <br /> 1997: A fire destroyed the commercial building. <br /> 1998: 03/27 Zoning Permit 98-1228 was issued for a single family residence for <br /> Dale Gates. Troy Gates states that"the house is almost completed." <br /> 08/02 Dale Gates,the business owner and husband of Karen and father of Troy, was <br /> killed in an auto accident. <br /> CURRENT SITUATION: Troy states that he and his mother"no longer plan to re-start the <br /> commercial operation." They wish to rezone the house and 2.1 acres to RH-1 -- "residential so <br /> [Karen) can continue to live there without being required to have a business operation." They also <br /> wish to rezone their remaining 7.6 acres to RH-2"so it can also be converted from commercial use to <br /> residential." <br /> Note: Although a small pond is shown on the proposed CSM(crossing the E PL of the RH-1 parcel), <br /> it is not shown on the County's official maps. However,Wetlands are shown on the E'ly 1/4+-of the <br /> RH-2 parcel. <br /> REGIONAL PLANNING <br /> Petition 7395. This 10-acre commercially zoned parcel currently has a single family residence, along <br /> with some material apparently remaining from the previous body shop business. <br /> The site is in an agricultural preservation area;however,the town/county plan allows for one division <br /> of such parcels if they are more than two acres in size. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> The property owner is not in compliance with the plumbing requirements for submitting the servicing <br /> reports for the existing holding tank system serving the dwelling on this premises. The holding tanks <br /> were installed prior to current code requirements that holding tanks be a system of last resort. <br /> Consideration should be given to assuring there is enough area on the parcel with the dwelling to allow <br /> conversion to a mound system if so desired in the future. <br /> DANE COUNTY HIGHWAY <br /> None <br /> OTHER <br />
