COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> ZONING REVIEW <br /> 14. 7372 Carl Williamson(Prestige Building,do Craig Swanson,agent),Sun Prairie 33 <br /> R-1A to R-2 <br /> The property to be rezoned is Lot 2, CSM 7634, which has frontage,but no vehicular access,on CTH <br /> TT. Instead,Lot 2 has a Private Access Easement onto Helgeland Drive. The <br /> location of road frontage determines which side of the lot is considered the `front yard' --in this case, <br /> the North property line or ROW of CTH TT. When the zoning permit to build a new house was issued <br /> on 06/10/1998,the address was correctly assigned on Helgeland Drive, since that is the driveway <br /> location. Looking at the lot as if the frontage on Helgeland were the front yard resulted in incorrectly <br /> approving a site plan which placed the house too close to the South property line, which is actually the <br /> rear lot line. (The"Lot Line,rear"is defined by DCCO Section 10.01(35) as"...that lot line which is <br /> opposite and most distant from the front lot line." This Petition seeks to remedy the staff error by <br /> down-zoning to the R-2 district,which has a rear yard setback of 35'. (The R-1A rear yard setback is <br /> 50';the house is 43.0 feet from the South property line.) Note that the minimum lot area for the R-2 <br /> district is 20,000 SF. Lot 2, CSM 7634 is 96,811 SF. <br /> REGIONAL PLANNING <br /> Petition 7372. This proposed residential rezone appears consistent so long as it does not result in <br /> additional development. We note that the R-1-A district has a minimum lot size of 1 acre(43,560 sq. <br /> ft.)and the proposed R-2 district has a minimum lot size of less than 1/2 acre(20,000 sq. ft.). <br /> Therefore, a condition limiting further development may be needed. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> DANE COUNTY HIGHWAY <br /> CTH"TT"is a controlled access highway. The property is not entitled to any new accesses. <br /> OTHER <br />
