DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> STAFF REPORT <br /> Petition 7376: Ervin Lee Public Hearing Date: 10/27/98 <br /> Town of Vermont Date of this report: 10/22/98 <br /> I. BACKGROUND <br /> A. Request <br /> Kendall Kahl, acting as agent for Ervin Lee, is requesting to rezone 26 acres from the A-1 <br /> (exclusive) district to the RH-4 district. At the same time,the Lees also seek to rezone a separate <br /> 3 acres from the A-1 (exclusive) district to the RH-1 district. Both parcels are intended for <br /> single family residences. <br /> B. History/Past Actions <br /> Petition 7316, approved by the County Board on 9/3/98, rezoned 4.1 acres of Mr. Lee's property <br /> in Vermont Township from A-1(ex)to RH-2. The pending Certified Survey Map associated <br /> with Petition 7316 would create a noncompliant three-acre A-1(ex)parcel. Mr. Lee now seeks to <br /> bring this nonconforming parcel into compliance by rezoning it to RH-1 with the current petition. <br /> The Lees own contiguous land on both sides of the Vermont/Cross Plains town line. This <br /> property is adjacent to 6.8 acres of land in Cross Plains proposed to be rezoned from A-1(ex)to <br /> RH-2 as part of Petition# 7350. On October 13, 1998,the Zoning and Natural Resources <br /> Committee recommended approval of Petition 7350, which is scheduled to be taken up by the <br /> County Board on November 5. <br /> C. Site/Locational Information <br /> The property is in the northeast quarter of the southeast quarter of Section 12, Town of Vermont, <br /> on the north side of Union Valley Road. The site is in a rural area, approximately 2.5 miles <br /> southeast of the Village of Black Earth. Both proposed lots are currently vacant and do not <br /> appear to be actively farmed. The area is a mix of cropland,pasture and woodlands. There is a <br /> farmstead immediately to the west, and two more scattered farmsteads some distance away to the <br /> east(see map, attached). <br /> D. Other federal, state or county approvals required <br /> A certified survey map will be required for both lots, and a delayed effective date is appropriate. <br /> County zoning and sanitary permits will be necessary before buildings can be constructed and <br /> occupied. Driveway permits may be necessary from the town. <br /> II. ANALYSIS <br /> A.
